STANDARD TERMS AND CONDITIONS OF SALE

1. General

These Standard Terms and Conditions of Sale ("Terms") govern the sale of products and services ("Products") by Creative Vision LC ("Seller") to the customer ("Buyer"). By placing an order or purchasing from the Seller, the Buyer agrees to these Terms. These Terms shall be interpreted in accordance with the laws of the Sultanate of Oman.

2. Orders and Acceptance

2.1. All orders placed by the Buyer are subject to acceptance by the Seller. The Seller reserves the right to accept or reject any order in part or whole.

2.2. The Buyer must provide complete and accurate information when placing an order. The Seller will not be responsible for any delays or issues caused by incorrect or incomplete order information.

2.3. Acceptance of an order by the Seller occurs when the Seller issues an order confirmation to the Buyer.

3. Prices

3.1. All prices are stated in Omani Riyals (OMR) unless otherwise specified and are exclusive of any applicable taxes, duties, and shipping costs unless specifically stated.

3.2. Prices may be subject to change without notice. However, once an order is confirmed, the price will remain fixed unless changes are required due to government regulations or external factors outside the Seller’s control.

4. Payment Terms

4.1. Payment is required at the time of purchase unless other terms have been explicitly agreed in writing between the Seller and Buyer.

4.2. Payment can be made through cash, debit/credit cards, or other approved methods specified by the Seller. Cheques will be accepted only after prior arrangement and are subject to clearance.

4.3. In the event of a failed payment, the Seller reserves the right to cancel the order or withhold delivery of the Products until full payment is made.

5. Delivery and Risk of Loss

5.1. The Seller will arrange delivery of the Products to the address specified by the Buyer. The Buyer is responsible for ensuring that the delivery address provided is correct.

5.2. Delivery times are estimates and are not guaranteed. The Seller is not liable for delays in delivery caused by factors beyond its reasonable control, such as transportation issues or customs delays.

5.3. Risk of loss or damage to the Products passes to the Buyer upon delivery to the specified address or the carrier, whichever occurs first.

6. Inspection and Acceptance

6.1. The Buyer must inspect the Products upon delivery and notify the Seller of any defects, shortages, or damages within [7] days. If no notice is given within this time frame, the Products are deemed accepted by the Buyer.

6.2. In the event of a valid claim for defective or damaged Products, the Seller may, at its discretion, either replace the Products or refund the purchase price.

7. Return and Refund Policy

7.1. The Buyer may return Products within [30] days of purchase for a refund or exchange, provided the Products are unused, in their original condition, and accompanied by the original receipt.

7.2. Refunds will be processed within [X] days of receiving the returned Products and will be made through the original payment method.

7.3. Certain Products (e.g., perishable goods, custom orders) are non-returnable unless faulty.

8. Warranty

8.1. The Seller warrants that the Products will conform to their specifications and will be free from defects in material and workmanship under normal use for a period of [X] months from the date of delivery.

8.2. The Seller’s liability under this warranty is limited to repair, replacement, or refund of the defective Products, at its discretion.

8.3. The warranty does not apply to damage caused by misuse, mishandling, improper installation, or any other condition beyond the Seller's control.

9. Limitation of Liability

9.1. To the maximum extent permitted by Omani law, the Seller shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the sale or use of the Products.

9.2. In no event shall the Seller’s total liability exceed the purchase price paid by the Buyer for the Products in question.

10. Force Majeure

The Seller is not liable for failure to perform its obligations due to circumstances beyond its reasonable control, including, but not limited to, acts of God, natural disasters, strikes, war, pandemics, or government regulations.

11. Governing Law and Jurisdiction

These Terms are governed by and shall be interpreted in accordance with the laws of the Sultanate of Oman. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Oman.

12. Amendments

The Seller reserves the right to amend these Terms at any time. The amended Terms will apply to any orders placed after the date of amendment.
